Background
The Safe Drinking Water and Toxic Enforcement Act of 1986 better known as California Proposition (Prop) 65 was designed to protect California's citizens and the State's drinking water sources from chemicals that are known to cause cancer, birth defects and reproductive harm. The Office of Environmental Health Hazard Assessment (OEHHA) maintains and publishes the list of chemicals, of which there are about 900.
Businesses need to provide a "clear and reasonable" warning before knowingly and intentionally exposing anyone to a listed chemical. There are some exemptions but the most important to food products is the exemption for exposures to the listed chemicals that occur naturally in foods.
Also exempted from labeling is listed chemicals below the OEHHA established safe harbor levels of which there are about 300 establish safe harbor levels.
